Course objectiveThe aim of the course is to identify how criminal process occur regarding right to fair trial in the light of the court decisions.  
Learning outcomes
  1. 1. will be able to identify requirements of the criminal process regarding ECHR a.6/1 a. explains right to trial by an independent and impartial tribunal established by law b. analyses right to hearing in a reasonable time. c. explains right to public hearing d. identifies requirements of the right to fair hearing
  2. 2. will be able to analyze the presumption of innocence regarding ECHR a.6/2 a. identifies basic information regarding presumption of innocence b. explains the principle of ?benefit of the doubt? c. identifies that ?burden of proof belongs the prosecutor? in criminal process d. analyses right to silence
  3. 3. will be able to identify requirements of the criminal process regarding ECHR a.6/3 a. explains right to be informed accusation b. analyses right to having time and facilities for the preparation of defense c. analyses right to defense by himself or lawyer d. identifies content of the right to principles of ?adversary process and equality of the arms? e. explains right to interpreter
Course ContentIn this course, the content of the right to fair trial will be identified and its reflections on criminal procedure will be discussed.
